By accessing or using Sellwhat ("the Service"), you agree to be bound by these terms. The Service is provided on an "as-is" basis for informational purposes only.

Artificial Intelligence Disclaimer. The Service relies on artificial intelligence ("AI") and large language models provided by third-party vendors to generate market analyses, financial projections, competitive assessments, and business recommendations (collectively, "AI-Generated Content"). By using the Service you acknowledge and agree to the following:

• Informational Only. All AI-Generated Content is provided for general informational and educational purposes only. It does not constitute — and must not be relied upon as — professional financial, legal, investment, tax, accounting, or business advice.
• No Guarantee of Accuracy. AI models can produce inaccurate, incomplete, outdated, or misleading outputs. Market data, economic indicators, demographic figures, revenue projections, cost estimates, and all other data points presented are approximations that may not reflect current real-world conditions. Sellwhat and Elbrus LLC make no representation or warranty, express or implied, regarding the accuracy, reliability, completeness, or timeliness of any AI-Generated Content.
• AI Hallucinations & Bias. Large language models are known to "hallucinate" — that is, generate plausible-sounding but factually incorrect information, including fabricated statistics, non-existent sources, and fictional market data. AI outputs may also reflect biases present in their training data. You should independently verify every claim, data point, and recommendation before acting on it.
• Not a Substitute for Professional Advice. You should consult qualified professionals — including but not limited to licensed attorneys, certified public accountants, financial advisors, and industry consultants — before making any business, financial, or legal decisions. The Service is not a replacement for professional due diligence.
• Variability of Results. AI-Generated Content may vary between analyses of the same location or business type due to the non-deterministic nature of large language models. Different runs may produce different conclusions, rankings, or financial estimates for identical inputs.
• Third-Party AI Providers. The AI models used by the Service are operated by third-party providers. Elbrus LLC does not control these models and is not responsible for their outputs, availability, or changes to their behavior. Your use of the Service is also subject to the terms and policies of these third-party providers.
• No Fiduciary Relationship. Use of the Service does not create a fiduciary, advisory, professional–client, or any other special relationship between you and Elbrus LLC.
• Assumption of Risk. You assume full responsibility for any actions taken based on AI-Generated Content. Elbrus LLC, its officers, directors, employees, and affiliates shall not be liable for any losses, damages, or costs — whether direct, indirect, incidental, consequential, or punitive — arising from your reliance on AI-Generated Content.
• Indemnification. You agree to indemnify and hold harmless Elbrus LLC from any claims, liabilities, damages, or expenses arising from your use of or reliance on AI-Generated Content.

Accounts. You are responsible for maintaining the confidentiality of your account credentials. You must not share, sell, or transfer your account.

Subscriptions. Paid plans are billed monthly or annually through Stripe. You may cancel at any time via your Account page; access continues through the end of the billing period.

Limitation of Liability. Elbrus LLC shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.

Changes. We reserve the right to modify these terms at any time. Continued use of the Service constitutes acceptance of revised terms.

Elbrus LLC ("we", "us") operates Sellwhat. This policy explains how we collect, use, and protect your information.

Information We Collect. We collect your email address at registration, analysis queries (location and budget), and usage data (pages visited, features used). Payment information is processed by Stripe and never stored on our servers.

How We Use It. Your data is used to provide the Service, improve our AI analysis pipeline, send transactional emails (verification, password reset), and, if you opt in, occasional newsletters.

Data Retention. Analysis results are cached for up to 30 days to improve response times. Account data is retained until you request deletion.

Third Parties. We share data only with service providers necessary to operate the platform: Stripe (payments), SendGrid (email), and xAI (AI analysis). We do not sell your data.

Your Rights. You may request access to, correction of, or deletion of your personal data by contacting us at info@sellwhat.ai.

Security. We use encryption in transit (TLS), secure cloud infrastructure, and access controls to protect your data.
